I NEED JUSTICE!!!

It would appear that you are already represented by the Duty Lawyer Scheme for your November hearing. From what you describe this will be a review hearing (of your sentence) to be heard by the magistrate who sentenced you.A Duty lawyer will be assigned to argue your review application. Ring the Duly Lawyer service to confirm your representation on the coming hearing date

If you want to overturn your conviction you will have to lodge a notice of appeal against your conviction. You have 14 days from the review hearing date to lodge a notice of appeal. you will need legal advice as to whether you have grounds for an appeal against conviction ( and possibly sentence)

You should find a lawyer promptly. If you have sufficient funds you can employ one privatly or in the alternative you can apply for Legal Aid for your appeal. If granted a lawyer will be assigned to your case (unless you specifically request a particular lawyer who agrees to take on the case for legal Aid in which cas LA will usually assign the case to that person).

The Law Society has lists of lawyers. You should go for one with experience doing mostly criminal cases. Do not listen to 'touts' and 'law clerks' who do not always have your best interests at heart.

Your Consulate may also be able to help you. Ask for Mr Gaspar 2823 8537

Best of luck

Please also note that the Law Society is organizing free legal advice sessions as part of Law Week 2005 at Metro Plaza in Kwai Fong (afternoons and evening) from Oct 29-Nov 6, 2005.

I know of many cases where the judge "belives the local chinese" and does not believe the usually "uneducated and poor filipinos". Sad to say, this is truly happening. But if you BELIEVE IN YOUSELF and present the evidence you can WIN the case. I worked as a volunteer before for Helpers for Domestic Helpers and I believe in fighting to the end.

Good Luck.

If you intend to clear you name, you should consider appeal against the decision of the Magistrate within 28 days from 7-NOV-2005. You can attend our office for an initial conference at a moderate fee. You can also consider applyig to the Legal Aid Department for assistance at telephone no. 2867 3071.

witley is absolutely right. even if you're a local - if you're poor, tough sh*t! you can't "afford" justice. a poor foreigner would at least have his/her embassy to run to for help; a rich foreigner would have the embassy plus the money to pay the right lawyers (right = best-connected).
