Maiden name

Is it legal to use maiden name after separation (not legally separated).Especially in working abroad and in visa applications.Any legal advise? Violations?

You can call yourself any name, even George Bush provided you are not doing it to cheat or in bad faith. It is not illegal. As for visa applications and filling other official documents, you should use the name in your passport or identity card.

Yes. There is no restriction for you to use your maiden name during the divorce proceedings, however, you have to make a "deed poll" (i.e. an declaration) to change your name and file the same to the court.



A deed poll only costs HK$1,500 to HK$2,000.

If you need a deed poll I can send you a precedent by e-mail. I recently did this in Hong Kong and got a friend who is a solicitor to witness it so it didn't cost me anything.
