Personal loan default

I loaned someone a large amount of money as a very personal favor. The person concerned is avoiding payment. We had a written agreement between us.

What legal remedy is available here in HK?

Which type of Lawyer (speciality?) is best to approach.

The Legal Advice Scheme provides free preliminary legal advice to members of the public as to their legal position in genuine cases. So this is a possible place to start where you can get advice from a lawyer without any cost.

You can also do this yourself. Small Claims for amounts up to $50,000 and District Court for $50,000 to $1m. I'm guessing this is over the 50K mark.


If this is a simple money claim (over $50,000) and the facts are simple without involving complicated argument on law, you may not need a lawyer.


There is a "Resource Centre for Unrepresented Litigants" office and website with information about how to do it yourself. If visiting the office, you might want to double-check about the Saturday opening.
