What is the legal situation on ebay transactions? If you don't pay the shipping insurance and the item is not delivered? I have no contract with the courier, just the vendor, which is a company.

I am considering taking this through small claims in HK if I have a case.

Did you pay with paypal, using your credic card? if you can claim non-receipt, the charge will be wiped off.
