LEGAL ADVICE.URGENT

we are living in Hong Kong form 12 years. this year in 2006 feb police officers came to my house and arrested my husband for suspected barglary. my husband is inosent and he didnot do any crime. since Feb my husband is on bail every month he have to go to police station and report there.

we consulted this case to a solicitar in march and he said this is very small case and its law in Hong Kong they cannot hold any budy on bail more then 6 months.

its already been 8 months now. last time when we went to police station they extended the bail again. this time when my husband enquire from concern officer he give same reply that case is passed to legal department so it can take 2 to 3 months more.

if there is anybudy who can tell me more about how to deal with this. it'll be big help.

It depends on the particular facts and evidence gathered by the police. Did your husband give any statement at the police station? If you want, we can have a meeting with you and your husband and our charge for a conference is HK$2,500.

Thanks alot Weir & Associates for your reply. Acctully the fact is that now we dont have money anymore. My husband is suffering from Degenerative Disc and our most of money is drained out in his treatment. thats why i am asking for help on asiaxpat. if anybudy knows anything about how the system works and what can we do to solve this problem it'll be big support.

Rachna, if you do not have any money, you should apply for legal aid for your case. This means the government will help you pay part, or all of the legal bills. There are plenty of good criminal lawyers in HK who will take your case on legal aid, in fact, it is a solicitor's duty to inform you of your right to legal aid if you cannot afford legal bills. Inquire your solicitor about this ASAP. You have my sympathies.

It does not seems that he is really charged. Is he qualified for legal aid in HK?

Your husband should had been appeared in front of a judge by now. The police can place yr husband under arrest for such a long time... Between his arrest till now, something must had transpired... It's hard to believe...
