5 years employed and getting sacked soon

Been working as a Supervisor in a restaurant for 5 years and 4 months.

The boss goes there daily and they are good friends with the cashier.


Me and the cashier had a big argument about something small but turned big and she said that I dont have anymore authority over her.

Ive figured that out long time coz the owners refuse to hear my side of the story on other major arguments.


I wrote the owner/boss a letter trying to explain my side of the story but as i handed it to her she said that soon their will be a change of staff. Clearly theyve made up their mind about me and that is to fire me.


I need to stay here until they do fire me but on what grounds.

What do i get if they do fire me?

Is their a difference between made redundant and fired for no reason other than i upsetted the owners favorite staff?


I see here that there is no reason for them to fire me other than they like her and prefer her more than me.


Can i ask the Legal Aid here for help or the Labour Department?


And since ive worked with them for more than 5 years, can i claim long service pay as well with severance payment?

If you visit the Labour Dept website I think you'll be able to find the answers to all your questions. There's a good guide to the Employment Ordinance that you'll be able to download and read at your leisure - or print it direct. I think you'll find that an employer can terminate an employee's contract at any time. There are rules covering 'unfair dismissal' but preference of one employee over another when they cannot work together effecively probably doesn't fall into that category. Good luck.
