Break Lease

I have a 12 month lease of which i am about 5 month in, i need to relocate, but not leaving hong kong and want to know if the landlord can legally hold me to the full term of the agreement or can i get away with just losing my deposit.

Any help on this greatly appreciated.

Legally, the landlord should be paid for the full term of the contract which you both agreed to and signed, unless there is a break clause in the lease. You cannot unilaterally break the lease; a mutual agreement is required.


Just about your only option is to make an offer to your landlord to surrender the tenancy. Then you both negotiate the terms, usually this means paying a sum in exchange for his/her acceptance of the surrender. The sum could be the total rent for the seven months or less, perhaps also including agents' fees, etc.

It does not make sense to accept seven months of rental as a buy-out sum. Must as well hold on to the unit and pay rental month by month.


The easiest way out of a lease is to get a new tenant who is willing to pay a higher rent or at least, you may top up the difference.

It makes sense to try negotiating with the landlord for a surrender of the lease upon terms agreeable to both parties so as to absolve your liabilities under the contract. Please contact our Ms Maria Chau for a conference at HK$2,500 if you wish to pursue with this matter further.
